Data Controller & Scope
GrowthCraftNetwork, registered at Seepromenade 8, 15859 Storkow, Germany, is the data controller for personal data processed through this website and through direct commercial correspondence. This Privacy Policy applies to visitors of growthcraftnetwork.com, clients engaging our digital agency services, and any individual contacting us at [email protected]. It fulfills the information duties under Articles 13 and 14 of Regulation (EU) 2016/679 (GDPR) and outlines the rights afforded to California residents under the California Consumer Privacy Act (CCPA).
Categories of Data & Purposes
We process: (a) identity and contact data (name, email, phone, company) submitted via the contact grid; (b) project brief content and commercial preferences such as budget range and service interest; (c) technical data (IP address, browser type, timestamps, cookie identifiers) collected for security and aggregate analytics. Purposes include fulfilling pre-contractual requests, delivering contracted web assets and hosting configurations, invoicing and accounting, responding to support incidents under active retainers, and defending legal claims.
Legal bases: Article 6(1)(b) GDPR (performance of a contract), Article 6(1)(f) (legitimate interests in operating and securing the service), Article 6(1)(a) (consent for optional cookies and marketing follow-up), and Article 6(1)(c) (statutory retention obligations under German commercial and tax law).
Processors, Transfers & Retention
Data is processed by vetted processors acting under Article 28 GDPR agreements, including our hosting provider, email transport provider, CRM system, payment processor for invoices settled via our secure payment link, and embedded map provider. Where a processor operates outside the EEA, transfers rely on adequacy decisions or Standard Contractual Clauses supplemented by technical safeguards.
Inquiry data is retained for up to 24 months after the last meaningful contact unless a contract requires longer retention. Invoices and accounting records are retained for 10 years as required by §147 AO and §257 HGB. You may request erasure at any time where no overriding legal retention duty applies.
Your Rights (GDPR & CCPA)
You hold the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), data portability (Art. 20), and objection to processing based on legitimate interests (Art. 21). Where processing rests on consent, you may withdraw it at any time without affecting prior lawful processing. You may lodge a complaint with a supervisory authority; our competent authority is the Berliner Beauftragte für Datenschutz und Informationsfreiheit as Landesbeauftragte, or the authority of your habitual residence. California residents may request disclosure, deletion, or opt-out of the “sale” or “sharing” of personal information (we do not sell personal data) by writing to [email protected]. We will not discriminate against you for exercising these rights. Verify requests may require reasonable authentication.
Subject Matter & Formation of Contract
GrowthCraftNetwork provides digital agency services including commercial web asset development, automated client acquisition system implementation, and enterprise hosting configuration. Services are offered to entrepreneurs and legal entities under these Terms. A binding contract is formed upon our written acceptance of a project proposal (statement of work) or upon delivery of paid milestones, whichever occurs first. Consumers withdraw under §312g BGB within 14 days where applicable; once the service has commenced at the consumer’s express request before the withdrawal period ends, a pro-rata fee for work performed may apply.
Scope, Fees & Payment
Each engagement defines deliverables, acceptance criteria, turnaround, and fixed fees in EUR or USD as quoted. Unless stated otherwise, prices exclude VAT where VAT applies. Invoices are payable within 14 calendar days via the payment link published in the site navigation or by bank transfer. Late payments accrue statutory default interest (§288 BGB) and may suspend active work and hosting operations after written notice with a further 7-day cure period.
Scope changes requested after written approval are estimated and billed separately at the then-current day rate only after you approve the updated estimate in writing (email suffices).
Delivery, Acceptance & Intellectual Property
Deliverables are provided in staged milestones with review windows of 5 business days each. If you do not report material non-conformity within the review window, the milestone is deemed accepted. Upon receipt of full payment, all intellectual property rights in client-specific code, copy, and design deliverables transfer to you; third-party components (fonts, libraries, stock assets) remain under their respective licenses. GrowthCraftNetwork retains the right to reference anonymized metrics and non-confidential visuals in its portfolio unless you opt out in the statement of work. You warrant that materials you supply (text, images, trademarks) do not infringe third-party rights.
Warranty, Liability & Termination
We warrant that services perform materially in accordance with the agreed specification for 90 days after acceptance; defects reported in that window are remedied without charge. Warranty excludes alterations made by you or third parties and issues caused by infrastructure, domains, or APIs outside our control. Liability is limited to foreseeable, typical damages under §765a context of commercial engagements; nothing limits liability for intent, gross negligence, injury to life or body, or mandatory product liability. Either party may terminate for material breach with 14 days’ written notice if the breach remains uncured. Retainers may be cancelled with 30 days’ notice at the end of a calendar month. Sections that by nature should survive (payment, IP, confidentiality, liability) survive termination.
Fixed-Price Projects
Fixed-price engagements are billed against milestones. If you cancel after a milestone is accepted, fees for completed milestones are non-refundable because the work product has been delivered. If you cancel before work begins on the next unpaid milestone, that milestone is not invoiced. Prepaid balances for milestones not yet started are refunded to the original payment method within 10 business days of a written cancellation request to [email protected].
Retainers & Hosting
Monthly retainers (including the Managed SLA Maintenance Retainer) are billed in advance for the current period and are non-refundable once the period has started; cancellation takes effect at the end of the paid period with 30 days’ notice. Enterprise hosting configuration fees cover one-time setup; subsequent monthly infrastructure fees are non-refundable after provisioning because reserved capacity cannot be resold. If we fail to meet a contracted uptime guarantee on a maintained environment, service credits equal to 10% of the monthly fee per 1% shortfall below the guarantee (capped at 100% of that month’s fee) are applied to the next invoice on request.
Right of Withdrawal & Refund Requests
Consumers within the EU have a 14-day right of withdrawal (§355 BGB, §312g BGB) from remote contracts. Where a service has been fully performed at your express request before expiry of the withdrawal period, a proportional amount may be retained. Defect-based refund claims are handled under the warranty terms in Art. 8. To request a refund or withdrawal, email [email protected] with your invoice reference; approved refunds are issued to the original payment method only. This policy does not limit mandatory statutory rights.
